General terms and conditions of sale

PREAMBLE:
Please read these General Terms and Conditions of Sale and General Terms and Conditions of Use of lamaisonvalmont.com, (hereinafter referred to as "the online shop") carefully. You can also print the full text by clicking here.
If you purchase goods on our website, you agree to be legally bound by this contract. These terms and conditions only apply if you purchase goods on our site as a consumer (i.e. for purposes outside your business, trade or profession).
By law, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that we must give you certain key information before a legally binding contract is made between you and us. If you would like to see this key information, please contact us using the contact details found on this page. If we need to change any key information once a legally binding contract has been made between you and us, we can only do so if you agree.

1. Identity of the seller

These General Terms and Conditions of Sale apply to sales from the online shop, including the company CVL Cosmetics SA, registered under tax number CHE-108.050.077. and its subsidiaries CVL Cosmetics South Middle Europe SLU and CVL Cosmetics Western European Countries SA.

- CVL Cosmetics South Middle Europe, SLU for the following countries: Belgium, Croatia, Cyprus, France, Greece, Ireland, Italy, Luxembourg, Malta, Netherlands, Portugal, Slovenia, Spain, United Kingdom; established in Avenida Diagonal 598, Ppal. 1, 08021 Barcelona, Spain. Registered in the Commercial Register of Barcelona under number B63385553 and with intra-community VAT number: ESB6338553.

- CVL Cosmetics Western European Countries SA, for the following countries: Austria, Bulgaria, Czech Republic, Denmark, Estonia, Finland, Germany, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia, Sweden and Switzerland; registered office at 18, Avenue de l'Université, 1005 Lausanne, registered in the Lausanne Trade and Companies Register under number CHE-115.146.506.

2. The client

2.1 The online shop offers the sale of products to non-professional customers, as consumers, who are eighteen (18) years old and have full legal capacity. The products are retailed for strictly personal use.

2.2 The Online Shop reserves the right to refuse any order for products of an abnormal nature, for example, in the case of orders with a quantity and/or amount considered unusual.

3. Outreach

These General Terms and Conditions of Sale apply to the online shop offering the sale of cosmetic products of the Valmont Group.

4. Languages

The online shop is available in French, English, Spanish, Italian and German.

5. Products

5.1 Our product and price offers are valid as long as they are visible in the online shop, while stocks last. In exceptional cases, errors or changes may occur, in particular in the case of simultaneous orders of the same product by several customers.

5.2 The products offered for sale in the online shop are described and presented as accurately as possible. However, the customer is advised to consult the description of each product by clicking on "Discover" for more information.

6. Price

Prices in the online shop are quoted in Euros and Swiss Francs, all taxes included, and are subject to change during the year.
Prices do not include shipping costs, which are charged in addition to the price of the  products purchased depending on the amount of the order. Shipping costs will be indicated before the customer confirms the order.

7. Registration and validation of the order

In the online shop, the customer selects the products of his choice and adds them to his section by clicking on "Add to basket". In the basket, customers can check the details of their order and modify it at any time. They then choose whether to register or not, fill in their billing details, the place and method of delivery and finally the payment method.

7.1 Product availability

In the event that a product is not available after the order has been placed, the customer will be informed and the amount of the non-delivered products will be refunded.

7.2 Order confirmation

Once the payment is confirmed, the customer will receive an order confirmation email.

At that point a legally binding contract will be established between you and us and we will send you the goods.
If you are under 18 years of age, you may not purchase any products on the site.

8 Promotional codes

8.1 If the customer has a promotional code, he/she must enter it in the "promotional code" box when placing the order in the online shop.

8.2 When a promotional code is accepted, the offer will be displayed on your shopping basket page.

8.3 Only one promotional code can be used per order.

9. Payment

9.1. Accepted cards and payment methods

Customers can pay for products by credit card. Cards accepted for payment are: Visa, Mastercard and American Express (UK only). PayPal, Alipay, WeChat Pay are also accepted for payment.
Payment by cheque is not accepted.
Payment by bank transfer is possible on request.

9.2. Security of payment

Payments are provided through our service provider ADYEN for Europe and UK and Postfinance for Switzerland.

9.3. Anti-fraud control:

The online shop has anti-fraud systems (including 3D Secure) provided by the service provider ADYEN.

10. Sending

10.1 Method of dispatch

Products will be shipped to the address indicated by the customer before payment. Deliveries will only be accepted to countries within the European Union, Switzerland and the United Kingdom.

10.2 Delivery times

The products will be shipped by the carrier, who undertakes to deliver them within the following deadlines:
Standard delivery: two to five working days.

11. Right of withdrawal

We hope you are delighted with your order, however, because you are a consumer and have purchased your product online, you have a legal right to cancel your Contract under the Consumer Contracts Regulations 2013 from the date of the Dispatch Confirmation (the date on which we send you an email to confirm our acceptance of your order) until the date which is 14 days after you receive the Products. This means that, during the relevant period, if you change your mind or decide for any other reason that you do not wish to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund.
Your right to return the goods does not apply to products

  1. manufactured to their specifications; or
  2. that have been clearly personalised (e.g. engravings); or
  3. which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly; or
  4. where sealed products have been delivered which are unsuitable for return for reasons of health protection or hygiene, if they are unsealed after delivery.

If you cancel your Contract, we will
we will refund the price you have paid for the goods. However, please note that the law allows us to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way that would not be permitted in a shop (or you can choose to have them returned to you within 14 days of our notification that we intend to make a deduction). If we refund the price paid before we can inspect the goods and we subsequently discover that you have handled them in an unacceptable way, you must pay us an appropriate amount.

  1. reimburse you for the delivery charges you have paid, although, as permitted by law, the maximum  reimbursement will be the cost of delivery by the least expensive delivery method we offer.
  2. make any refund due to you as soon as possible and in any event within 14 days of the day on which we receive the Products back from you or, if earlier, the day on which you provide us with proof that you have returned the Products to us.
  3. reimburse you for the amount of the credit or debit card or other payment method used by you to pay. If you used vouchers to pay for the Products, we may reimburse you in vouchers. You will receive an email notification of your refund from our customer service team.

11.5 We undertake to provide our customers with the best cosmetic products available. If the customer has already received the product and considers that the products delivered by us do not meet this expectation, the customer has the right to withdraw from the contract, without providing any justification, within fourteen working days after the date of receipt of the ordered products.

11.6 Modalities for exercising this right:
a. Return the product directly together with the return form duly completed, filled in and signed.
b. Send an e-mail to Customer Service (see section above entitled: "Customer Service") with the following information: name, postal address, telephone number and order number.

11.7 The products in question must be returned as indicated below:
- For Switzerland, the products in question must be returned to Planzer Transports (Valais).

A/A CVL Cosmetics WEC SA, X. Darioli / A. Debons, 2, Rue des Fougères, 1964 Conthey, Switzerland.
- For all other countries, products should be returned to the following address: DISPEO - HappyColis / Valmont, Rue Hippolyte Bayard, 60000 Beauvais, France.
- For health and hygiene reasons, products must be returned in their original packaging, intact and in perfect condition for resale.

11.8 Valmont will reimburse the amount of the returned products within a maximum period of 14 days. The shipping costs shall be borne by Valmont.

12. After-sales service

No exchanges or claims will be accepted for products purchased in the online shop. Such exchanges and claims cannot be made in shops where products bearing the Valmont brand are sold.

13. Legal safeguards

Valmont warrants that the products are fit for their intended use and that such products are free from defects or hidden defects that make them dangerous or unfit for normal use. Valmont also guarantees the authenticity of all products sold through authorised distributors of the Valmont Group.

14. Applicable law

14.1 These General Terms and Conditions, as well as any orders placed in the online shop, are subject to the law of England and Wales to the exclusion of any provisions applicable under foreign law. However, the application of the law of England and Wales may not lead to the deprivation of the customer of the same level of protection as that provided by the provisions of mandatory law in his country of habitual residence.

15. Limitation of liability

15.1 Except for any legal liability which we cannot exclude by law or which arises under applicable laws relating to the protection of your personal information, we are not legally responsible for
a. losses which were not foreseeable by you and us at the time of the conclusion of the contract;
b. losses that are not caused by any default on our part
c. commercial losses; or
d. losses to non-consumers.

15.2 In the event that Valmont is liable for damages suffered by the Customer as a result of non- performance or improper performance of its services, such liability shall be limited to the amount of the order paid by the Customer.

15.3 We do not exclude or limit in any way our liability to you where it is unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or sub- contractors; for fraud or fraudulent misrepresentation; for breach of your statutory rights in relation to the Goods as summarised in clause 6; and for defective Goods under the Consumer Protection Act 1987.

15.4 We only supply Products for domestic and private use. You agree not to use the Products for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. 16. Privacy

Your privacy and your personal information are important to us. Any personal information you provide to us will be treated in accordance with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share that information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.

17. Rights of Third Parties

No person other than a party to this contract has the right to enforce any provision of this contract.

18. Transfer of Rights

We may transfer our rights and obligations under these Terms and Conditions to another organisation, and we will always notify you in writing if this happens, but this will not affect your rights or our obligations under these Terms and Conditions. You may only transfer your rights or obligations under these Terms to another person if we agree in writing.
